对条约*在国际法中的地位、缺陷与发展趋势问题的探讨

On the Question of the Treaty’s Status in International Law

Abstract: Treaty plays a very important role in the contemporary international law, we even can say that its status is fundamental. The principal reasons of saying so are: firstly, in a sense, the history of the treaty’s emerging and developing at the same time is the history of the international law’s emerging and developing; secondly, the treaty, as the most important source of international law, constitutes the fundamental frame and regime of the contemporary international law; finally, nowadays, treaty has become a basic manner and method of the subject of international law in interactions in international relations.

对条约*的缺陷与发展趋势问题的探讨

内容摘要：尽管条约作为当代国际法上的最重要的渊源，在国际关系中占有极其重要的地位，但是，由于条约作为确定各类国际法主体之间的权利和义务关系的一种国际法规范，难免涉及到国家利益的冲突，因此，条约也具有其自身的缺陷，诸如条约的非普遍性、条约执行的非自动性以及条约往往不能得到很好的遵守和执行等等。但不管怎么样，随着全球化的不断深入发展，条约在国际法中的日益重要的地位不会改变，而且可以预见的是，条约特别是一般性多边条约将会增多，条约的缔约主体将会增加，条约的普遍性及其效力也会加强。
